Figures shown here are placeholders carried over from the Dutch version, and the wording about which law and courts apply is intentionally generic until that decision has been made. 1. Definitions

In these rental terms, the following definitions apply.

“MyBoothBox” means the business under which photobooths are rented out.

“Renter” means the individual or organization who rents a photobooth via our website.

“Rental item” means the photobooth rented out by MyBoothBox, including its accessories (camera, screen, lighting, printer and other accessories) as described on the website.

“Rental period” means the period stated on the booking confirmation during which the renter may use the rental item.

“Event date” means the date booked by the renter on which the rental item will be used.

2. Applicability

These terms apply to every quote, booking and rental agreement between MyBoothBox and the renter.

Any deviation from these terms is only valid if MyBoothBox has confirmed it in writing.

Any purchasing or other terms proposed by the renter are expressly rejected.

3. Formation of the rental agreement

Offers on the website are non-binding. A rental agreement is formed once the renter completes a booking and MyBoothBox confirms it by email, or once MyBoothBox actually begins carrying out the booking.

Immediately after booking, the chosen event date is reserved exclusively for the renter, which means other requests for that same date may be declined.

Promotions, discounts and special rates apply only to new bookings, while supplies last, and cannot be applied retroactively to existing bookings.

4. Rental price and payment

The rental price and any additional costs (for example extra prints, an extended rental period, or the optional damage insurance) are shown on the booking confirmation. All prices include applicable tax unless stated otherwise.

The full rental price must be paid before the rental item is delivered, unless otherwise agreed in writing.

If payment is not made on time, MyBoothBox may suspend delivery or terminate the agreement, without prejudice to its right to compensation for damages and costs.

MyBoothBox does not charge a separate security deposit. Under these terms, the renter is liable for damage, loss and theft of the rental item; Article 9 sets out what the renter owes in that case and to what extent optional damage insurance limits that liability.

5. No right of cancellation/withdrawal

Because this is the rental of an item tied to a fixed event date, this booking is not subject to a general right of withdrawal or a cooling-off period, in the same way that time-bound leisure and event services are commonly excluded from such rights.

The renter expressly acknowledges this when completing a booking and thereby waives any right of withdrawal or cooling-off period.

Note: which consumer-protection rules actually apply, and whether an exclusion like this is enforceable, depends on the laws applicable in your jurisdiction — see the note on jurisdiction at the top of this file. This section should not be relied on until a lawyer has confirmed it holds up under the rules that actually apply to this business.

6. Cancellation and changes

The event date is reserved exclusively for the renter immediately after booking. If the renter cancels, for any reason, the full rental price (100%) remains due. Amounts already paid are not refunded.

The renter may reschedule the booked date once, free of charge, provided the request is submitted in writing at least fourteen (14) days before the original event date and the new date is available and falls within twelve (12) months of the original date.

A change requested within fourteen (14) days of the event date, or a request to move to a date on which the rental item is not available, is treated as a cancellation and the full rental price (100%) remains due.

If MyBoothBox cancels or changes the booking due to circumstances beyond its control (such as equipment failure that cannot be fixed or replaced in time, delivery/carrier failure, or government measures), the renter's only remedy is a refund of amounts already paid or a replacement date, at the renter's choice. Further liability is excluded.

7. Delivery, return and rental period

The rental item is delivered by MyBoothBox or a carrier it engages, to the address provided by the renter, normally one (1) business day before the event date.

The renter must ensure someone is present at the agreed delivery time to receive the shipment and store it somewhere dry and secure.

The rental period ends on the next business day after the event date. The renter must hand over the rental item on that business day, at the drop-off point or to the carrier designated by MyBoothBox, in the original or equivalent packaging.

If the rental item is not offered for return by the next business day after the event date at the latest, the renter is automatically in default and owes a fee of $25 for each calendar day of delay that has begun, without prejudice to MyBoothBox's right to compensation for further damages.

In the event of loss, theft, or failure to return the rental item, the renter owes the full replacement value of the rental item, plus administrative costs.

8. Use of the rental item

The rental item is rented out by MyBoothBox solely for the event specified by the renter. Subletting, re-renting, or making it available to anyone outside the event's guests is not allowed without MyBoothBox's prior written consent.

The renter must use the rental item carefully and only in accordance with the instructions supplied with it or available online.

The rental item may only be used under the following conditions: indoors, or in a fully covered and weatherproof space (such as a tent, event hall or marquee); not in direct sunlight; at an ambient temperature between 50°F and 95°F; at a relative humidity between 30% and 80%; and kept away from liquids, food, fire, smoke, or anything else that could cause damage.

The rental item may not be disassembled, opened, modified, have stickers or markings removed, or have safety features disabled.

The renter must ensure that guests also use the rental item in accordance with these terms, and is fully responsible for their actions.

9. Damage, theft and renter liability

From the moment of delivery until the moment the rental item is received back by the carrier or by MyBoothBox, the renter bears the full risk of loss, theft and damage, regardless of cause or fault.

Damage to the rental item (including drop damage, liquid damage, damage in transit on return, defective or missing parts, and cosmetic damage) is compensated by the renter at repair or replacement cost, plus any lost rental income while the item cannot be rented out.

In the event of theft or loss, the renter owes the full replacement value of the affected part of the rental item. Loss of accessories such as the printer, camera or cables is billed separately.

If the renter has not purchased the optional damage insurance described below, the renter compensates the damage in full, themselves. There is no fixed amount and no upper limit: what is owed is whatever repair or replacement actually costs. MyBoothBox will substantiate the amount charged, on request, with a repair invoice, a repairer's quote, or the replacement part's purchase value.

The renter may purchase optional damage insurance for the amount stated on the website. This insurance covers unintentional damage to the rental item that occurs during the event, subject to the exclusions below, and only for damage that occurs after the insurance was purchased. In that case, the renter owes only a deductible of $100 per damage event, and MyBoothBox covers the remainder. If the damage is less than the deductible, the renter owes only that lower amount. The deductible applies per damage event.

The damage insurance does NOT cover: theft, loss, or a missing rental item or part of it (see above); damage caused by intent, willful recklessness, or gross negligence by the renter or their guests; damage caused by using the rental item outside the conditions in Article 8 (including damage from being left outside or in direct sunlight, from excessive or insufficient temperature or humidity, or from liquid, food, fire or smoke); damage caused by disassembling, opening or modifying the rental item, or disabling its safety features; damage that occurred before or after the event, including damage during storage by the renter or damage in transit on return; and the late-return fee and full replacement value described above for a non-returned item — those are not damage to the rental item and are not insured.

The renter must report damage, theft or any other incident immediately — within 24 hours at the latest — in writing to MyBoothBox. In the event of theft or vandalism, the renter must file a police report and make it available to MyBoothBox.

10. MyBoothBox's liability

MyBoothBox is only liable for direct damage that is the direct result of a failure attributable to MyBoothBox.

MyBoothBox's total liability is limited to the rental price of the relevant booking, or, if higher, the amount actually paid out by its insurance in the case in question.

MyBoothBox is not liable for indirect damage, consequential damage, lost profit, missed photos or recordings, damage to the event itself, reputational damage, or damage from the rental item failing due to incorrect use by the renter or their guests.

These limitations on liability do not apply in cases of intent or willful recklessness by MyBoothBox or its management.

11. Privacy and photos

MyBoothBox processes the renter's personal data solely to carry out the booking, in accordance with its privacy policy and applicable data-protection law.

The renter is responsible for the photos taken during the event with the rental item, and for informing their guests that photos are being taken.

If MyBoothBox provides an online gallery, the renter must ensure that gallery is only shared with others to the extent the people pictured have consented to that.

12. Photos, usage rights and image/likeness rights

The photos taken during the event with the rental item belong to the renter and their guests. MyBoothBox does not publish them or use them for its own purposes; it processes them only to store them and make them available to the renter through the customer portal, as described in its privacy policy.

During the event, each guest can send their own photo straight to their phone via a QR code on the screen. This is included with every package, with no maximum number of photos. The digital photo album containing all photos after the event is a separate product: the renter can purchase it for the amount stated on the website, or receive it free of charge by submitting footage as described below.

The renter must inform their guests in advance that photos are being taken and is responsible for obtaining their guests' consent. MyBoothBox does not invite the guests, has no contact with them, and therefore cannot obtain that consent itself.

If the renter provides MyBoothBox with footage of their event — for example, a photo of the set-up photobooth, or a short video of guests using it — the renter thereby grants MyBoothBox the right to use that footage for: MyBoothBox's own website, customer portal and newsletter; MyBoothBox's own social media channels; and advertising and printed materials promoting MyBoothBox's own services.

Copyright in that footage remains with its creator. MyBoothBox obtains a usage right, not ownership: it does not sell the footage or make it available to others for their own purposes. Footage used in an advertisement is, however, supplied to the relevant advertising platform in order to run that ad. MyBoothBox keeps the footage for as long as it uses it for the purposes above.

Consent for this use is explicit: it is given separately, at the moment the footage is submitted. Consent that would only follow from accepting these terms, from booking, or from the act of submitting the footage itself, is not sufficient.

The renter warrants that every recognizable person shown has consented to this use. For a recognizable person under sixteen (16) years old, consent from a parent or guardian is required. If the renter cannot obtain that consent, the renter must not submit the footage, or must supply it without that person recognizably shown.

Consent can be withdrawn at any time, for any reason or no reason, free of charge, by the renter or by a recognizable person themselves, by writing to MyBoothBox.

After a withdrawal, MyBoothBox will not reuse the footage and will remove it within ten (10) business days from the channels it directly controls. Footage already included in printed materials, in a live ad campaign, or copied or shared by others, cannot always be recalled; MyBoothBox will make reasonable efforts to have that use stopped as soon as possible. Withdrawal applies going forward and does not affect use that already happened. It has no effect on a free digital photo album the renter already received; that album remains available.

13. Force majeure

In the event of circumstances beyond its reasonable control (including but not limited to delivery/carrier failures, illness, fire, theft before delivery, equipment defects that cannot be fixed in time, pandemics, or government measures), MyBoothBox may suspend or cancel performance of the agreement.

In that case, the renter may choose to have amounts already paid refunded, or applied to a replacement date, without MyBoothBox owing any further compensation.

14. Final provisions

These terms, and any agreement between MyBoothBox and the renter, are governed by the laws applicable in your jurisdiction.

Any dispute will be resolved under applicable law, before the competent court or forum for that jurisdiction. (As explained at the top of this file, this deliberately does not name a specific US state, court, or arbitration process — that choice still needs to be made and reviewed by a lawyer.)

If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force. In that case, the parties will discuss a replacement provision that comes as close as possible to the intent of the original.
